Terms of Service

Last updated: 3 July 2026. These terms and conditions are the agreement between Voitly and the restaurant that uses it. They are written in plain English on purpose. If anything is unclear, ask us before you rely on it: [email protected].

1. The agreement

By creating a Voitly account or using the service, you agree to these Terms of Service and to our Privacy Policy. You are entering this agreement on behalf of a business, and you confirm you have the authority to bind that business. Voitly is a business tool for restaurants and is not offered to consumers for personal use.

2. What Voitly is

Voitly is an AI ordering service for restaurants. Its core is an AI phone agent that answers your restaurant's phone and takes orders by voice, around the clock. It also includes a kitchen display, menu management, and an optional QR table ordering add-on that lets guests order from the table in their own language. Orders from both channels land on the same kitchen display.

3. Your account

  • Keep your login credentials confidential. You are responsible for activity under your account.
  • Give us accurate account and billing information and keep it up to date.
  • You must be at least 18 years old to create an account.

4. Trial, plans, and billing

  • Free trial. New accounts get 7 days free. No card is required to start, and the trial does not convert into a paid plan by itself.
  • Subscriptions. Paid plans are billed monthly in advance at the prices shown on our pricing page. Payments are processed by Stripe.
  • Usage charges. Plans include a bundle of AI phone minutes. Usage beyond the bundle is billed at the flat per-minute rate shown on the pricing page.
  • Price changes. If we change a price, we will tell you by email at least 30 days before it affects you. Existing subscriptions keep their price until then.
  • Cancellation. You can cancel any time from your dashboard. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where the law says otherwise, fees already paid are not refunded.

5. Your menu and your content

Your menu, prices, item descriptions, allergen information, and branding stay yours. You give us a licence to host, display, and process that content only as needed to run the service for you.

Accuracy matters. The AI answers guests based on the menu data you enter. You are responsible for keeping it accurate and current, and this matters most for allergen and dietary information. The AI flags allergens using the data you provide. It cannot catch an allergen you never entered.

6. Your responsibilities as a restaurant

  • Comply with the laws that apply to your business, including food safety, consumer protection, and data protection law.
  • Where phone calls are recorded or transcribed, provide any caller notice or obtain any consent your local law requires.
  • Tell your guests how their order data is used where local law requires it. Our Privacy Policy describes how Voitly processes guest data on your behalf.
  • Honour the orders the service takes for you, or refund the guest where you cannot.

7. Acceptable use

Do not misuse the service. That includes: attempting to breach or probe its security, reselling it without our written agreement, using it to send spam or unlawful content, uploading content you have no right to use, or interfering with other customers' use of the service. We may suspend accounts that put the service or other customers at risk, and we will tell you why.

8. AI accuracy

Voitly's conversations are powered by AI. It is tuned to be careful: it does not invent menu items and it treats allergy questions conservatively. But no AI is perfect and neither is any human order taker. Occasionally it may mishear, misunderstand, or need to hand a call to a human. You should review incoming orders in your kitchen workflow the same way you would review orders taken by staff. Voitly does not guarantee that every individual order will be error free.

9. Guest transactions

The sale of food and drink is between the restaurant and the guest. Voitly transmits orders. We are not a party to the meal transaction, we do not take title to goods, and disputes about an order, its preparation, or its refund are between the restaurant and the guest.

10. Intellectual property

Voitly's software, design, and brand belong to Voitly. We give you a non-exclusive, non-transferable right to use the service while your subscription is active. Feedback you send us may be used to improve the product without obligation to you.

11. Data protection

We process guest order data on your behalf and on your instructions, as described in the Privacy Policy. We do not sell personal data and we do not use your guests' order data to train foundation AI models. You can export your data or ask us to delete records at any time.

12. Availability and changes

We work to keep Voitly available around the clock, because that is the point of the product, but we do not promise uninterrupted availability. Maintenance, third-party outages such as telephony carriers, and events outside our control can cause downtime. We may improve or change features over time. If we discontinue a feature material to your use, we will give you reasonable notice.

13. Disclaimers and limitation of liability

The service is provided "as is" and "as available". To the fullest extent the law allows: we exclude implied warranties, we are not liable for indirect or consequential losses such as lost profits or lost business, and our total liability for all claims in any 12 month period is limited to the fees you paid us for the service in the 12 months before the first claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for fraud, or for death or personal injury caused by negligence.

14. Termination

You can stop using Voitly and cancel at any time. We may suspend or terminate your account if you materially breach these terms and do not fix the breach within 14 days of our notice, or immediately if the breach is serious, for example unlawful use or a security threat. After termination we will make your data available for export for 30 days, then delete it in line with the Privacy Policy.

15. Changes to these terms

We may update these terms as the product and the law evolve. If a change is material, we will email account holders at least 30 days before it takes effect. Continuing to use the service after that date means you accept the updated terms. If you do not accept them, cancel before they take effect.

16. Governing law

These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory law in your country gives you additional rights or requires a different forum.

17. Contact
